In June of 2026, just before trial, Adams & Associates, on behalf of its client, a victim of sexual assault, settled her case against The River Source Casa Grande, an Arizona inpatient drug and alcohol treatment center, for $2 million dollars.

The case involved a 19-year-old woman who was sexually assaulted by another patient while she was receiving inpatient treatment at The River Source. The assailant, identified in the litigation by his initials, had an extensive criminal history that included a prior rape charge and convictions for domestic violence, child abuse, and assault with a deadly weapon.

According to the plaintiff’s claims, the assailant also admitted during intake that he was a sex addict and a “womanizer.” Despite those warning signs, he was admitted into the facility, where the assault later occurred.

Claims Against the Treatment Facility

The plaintiff alleged that The River Source Casa Grande failed to take reasonable steps to protect her while she was in its care. The defense denied liability and contended that the plaintiff’s damages were caused solely by the criminal conduct of the assailant.

The plaintiff was prepared to present expert testimony from Michael Sucher, M.D., who was expected to testify that the assailant should not have been admitted to the facility given his violent background and the information disclosed during intake. The expert was also expected to testify that the facility was understaffed and failed to follow its own policies and procedures.

Serious Physical and Emotional Harm

The plaintiff suffered both physical injuries and severe mental health damages as a result of the assault. Cases involving sexual assault in treatment, recovery, medical, residential, or institutional settings can be especially traumatic because the victim is often in a vulnerable position and dependent on the facility for safety, supervision, and care.

The parties reached a binding settlement during a settlement conference facilitated by the Honorable Christopher Whitten. The total settlement payout was $2,000,000 and included a full release of all claims.

The settlement was reached without any admission of liability. Larry Cohen, a renowned Arizona Plaintiff’s lawyer, was associated as counsel in this case, and was also instrumental in bringing about the settlement.

Accountability in Institutional Sexual Assault Cases
